Environmental liability laws widen polluters' obligations


PORTS and shipping face a new era of environmental liabilities in Europe, but experts are warning there is little wider awareness of the extent of the change.

The Environmental Liability Directive has been rolled out into member state law since 2007, after it was passed by the European Union in 2004 and following initial discussions back in 1990.

England adopted the ELD only two months ago, with Wales, Scotland and Northern Ireland yet to adopt it, leaving the UK government paying a fine of EU100,000 ($139,000) per day to Brussels for non-implementation.

Simon White, environmental manager with London market underwriter XL Insurance, said that although the ELD was aimed at landside environmental incidents, it had a direct impact on port operators and shipping in and around coastal and estuary areas.
