
On May 21, 2009, the Senate approved a law to combat wage inequality between men and women in Chile. The law, which requires employers to institute formal complaint and follow-up procedures and in some cases keep detailed records of their compensation practices, will become effective in December 2009.
Key Details
The main features of the law are as follows:
* Companies with more than 10 employees will be required to institute procedures to allow workers to submit formal complaints if they suspect that they are the victims of wage discrimination.
* Once a formal complaint has been submitted, employers will have 30 days to provide a written response. Should the employer fail to give a reasonable reply, employees will have the right to appeal to the Labor Justice department.
