
The Data Protection Act requiring every organisation involved in the processing of personal information to register with the Information Commissioner was introduced in 1998. However, many accountancy firms have yet to inform the commissioner that they hold key client and staff information on databases, despite warnings that they will face fines and prosecution for failure to do so.
And now accountants are to be targeted by the commissioner to register in order to be able to legally store personal information on their IT systems.
Registration comes at an annual charge of £35. Should any business fail to register, then, in the first instance, it will be sent an enforcement notice informing it that it must comply.
Failure to respond can lead the Commissioner to pursue the matter as a criminal offence with a fine of up to £5000, plus costs.
