
A new national Employment Promotion Law that will take effect on January 1, 2008, intends to prohibit job discrimination.
The National People’s Congress Standing Committee passed the bill on August 30, 2007. The main provisions that will affect employers are:
* Employers will not be allowed to consider gender, ethnicity, race, religious belief, physical disability or infectious diseases when filling jobs. Also, job seekers will have the right to sue employers for discrimination.
* Female workers will have the same rights as male employees. Employers will not be allowed to reject female applicants because of gender or to set higher recruitment standards for female applicants.
* Migrant workers will be entitled to equal employment rights, and discriminatory practices against their recruitment will be banned.
* Enterprises will be required to fund employee education, open vocational skill training courses and continuing education.
