Bank whistleblower scores a victory


With the coming of a new administration, we wondered if whistleblowers seeking protection under Sarbanes-Oxley (Sarbanes-Oxley news) would fare any better. Recall that they fared poorly under the previous administration because of administrative rulings that the law only applied to holding companies, not subsidiaries. It remains to be seen if there's been a major change.

But we can note the example of the former CFO of Tennessee Commerce Bancorp. A Department of Labor's OSHA has ruled that George Fort should get his job back, plus more than $1 million in back pay and other compensation. The bank intends to appeal.
