Here to Stay: The Trend Toward Transparency in Health Care Compliance


Over the past year, increased transparency has been a dominant trend in health care compliance, particularly for drug and medical device manufacturers. This article describes specific examples of enhanced transparency expectations and the factors that contribute to them, and concludes with suggestions for compliance professionals to adapt to these changes.

Increased compliance transparency has taken different forms, depending on the impetus for the change. Some increases in transparency have occurred as a result of demands from governmental regulators charged with enforcing heath care regulatory laws. The U.S. Department of Justice set new records in 2009 for fraud and abuse recoveries from the health care industry, securing $2.4 billion in civil settlements and judgments in cases involving allegations of fraud against the government.
