
The flexibility given to EU member states for transposing the 2004 environmental liability directive (ELD) into national law and the different interpretations that resulted from this have led to uneven implementation across the bloc's 27 nations, according to the European commission.
"Where the directive gives member states the flexibility to choose what action to take, we see a diverse picture across Europe", Hans Lopatta of the commission's environment directorate told an industry seminar in Brussels on Tuesday.
The ELD requires polluters to pay financial compensation for causing significant environmental damage. But member states are free to decide how stringent their domestic liability regimes should be.
