
Policy Accomplishments for 2006
Attorney-Client Privilege Waiver
Working with a broad coalition of business and legal groups, helped persuade the U.S. Sentencing Commission to strike language that made the waiver of attorney-client privilege determinative of whether a company was cooperating with a government investigation. Filed an amicus brief that successfully challenged Department of Justice policy that threatens companies under investigation with indictment if they pay for their employees legal representation.
Mutual Fund Rule
Won a significant victory when the DC Circuit Court of Appeals again rejected a Securities and Exchange Commission (SEC) rule that would have required the boards of mutual funds to have an independent chair with 75% of their directors being independent.

Auditing Profession
Testified before a congressional subcommittee on how to improve auditing and accounting practices, ensure the viability of the profession, and encourage greater focus on long-term performance metrics.
