As the awareness of The Family Medical Leave Act (FMLA) increases, so has compliance risks and costs associated with misunderstanding FMLA provisions for employers. Due to the complexity of this Act, compliance can not only be confusing but also costly.
As more employees become familiar with FMLA, potential for misuse is also a concern. When asked, an increasing amount of employers feel they have granted unfounded FMLA time off in the past years. Being unclear on regulations as well as fear of legal action are common reasons for approving questionable employee leave requests.
