Ethisphere Symposium: OECD Good Practice Guidance for Companies

Businesses with international sales and operations have been attempting to comply with the Foreign Corrupt Practices Act for several years. Despite enhanced global enforcement and enhanced compliance, the Department of Justice has not yet given meaningful guidance on how they expect companies to comply with the FCPA. Fortunately, the Organisation for Economic Co-operation and Development (OECD) has issued the "Good Practice Guidance” for anti-corruption and anti-bribery compliance programs and it has received the DOJ’s endorsement. The UK Bribery Act is also coming online and requires companies to have "Adequate Procedures” or face criminal prosecution. And the Bribery Act covers new ground that was not addressed by the Foreign Corrupt Practices Act.
